Terms of Service

These terms apply to the Tobien website, app and related language learning services operated by Vadym Dobroskok in Spain. They describe what you can expect from the service and your responsibilities when using it. By using Tobien, you agree to these terms. If you do not agree, do not use the service.

1. What Tobien provides

Tobien is a reading companion for language learners. Its features can include book imports and discovery, reading tools, vocabulary explanations, AI conversations, learning history and adaptive practice. Features, supported formats, languages and usage allowances can vary by version and account.

You are responsible for your device, internet connection and any related charges. Some features require an account and a connection to our servers. Downloaded review material may be used offline where that feature is available.

2. Eligibility and your account

You must be legally able to agree to these terms. If parental or guardian permission is required where you live, obtain it before using Tobien. Do not use someone else’s account or provide misleading account information.

Protect the Apple or Google account you use to sign in and the devices on which you use Tobien. Let us know if you suspect unauthorised access. You are responsible for activity you authorise through your account, subject to your rights under applicable law.

3. Your books, questions and other content

You keep the rights you hold in the files, questions and other material you provide. Upload only material you own or are authorised to use with the service, including its server processing and AI features. A book being available online does not necessarily make every use of it lawful.

You give Tobien the limited permission needed to host, copy, extract, process and display your material to provide the service, including generating explanations and practice through service providers. This permission does not transfer ownership of your books to us or grant a general right to sell or publish them.

Keep your own copies of important files. Tobien is a learning service and should not be your only archive. Removing content or an account is subject to the retention and deletion information in our Privacy Policy and any applicable legal requirements.

4. AI features and learning results

Translations, explanations, conversations and exercises may be generated by AI. They can contain mistakes, omit context or give different answers to similar questions. Check information that matters to you, and use these features as learning support rather than as a guarantee of accuracy.

Tobien does not guarantee a particular language level, examination result or learning outcome. AI responses are not professional legal, medical or financial advice. Do not submit sensitive or confidential material unless you are comfortable with the processing explained in the Privacy Policy.

5. Acceptable use

Use Tobien lawfully and respect other people’s privacy and intellectual property. Do not upload unlawful material, impersonate another person, or use the service to harass others or distribute malicious software.

Do not try to access another account, bypass authentication or usage limits, disrupt the service, or automate abusive requests. Do not reproduce or exploit the app or its proprietary software except as permitted by these terms or applicable law.

We may limit or suspend access where reasonably necessary to investigate misuse, protect the service, meet legal requirements or address a material breach of these terms. Where appropriate, we will explain the reason and provide a way to contact us about the decision.

6. External services and book catalogs

Tobien can connect to Apple, Google, AI providers and external book catalogs. Their separate terms govern your direct use of those services. Catalog books may have their own copyright, licence and geographic restrictions; check the source before using a title.

External services can change or become unavailable, affecting features that rely on them. Links are provided for convenience and do not mean that Tobien controls or endorses every item available from an external source.

If you receive the app through the App Store or TestFlight, the applicable Apple distribution terms also apply. Tobien support and questions about these terms should be directed to vd@tobien.app.

7. Plans, limits and future paid features

Access to features may be subject to account allowances, credits, technical limits or a preview programme. A displayed plan or credit balance does not by itself mean that a purchase or recurring payment has been activated.

If paid features become available, the price, billing period, renewal conditions and cancellation information must be shown before you confirm a purchase. Any applicable purchase terms and mandatory refund or withdrawal rights also apply. These terms alone do not authorise us to charge you.

8. Availability and changes

We may maintain, update or change Tobien as it develops. Preview and beta versions can be incomplete, contain faults or change before release. We cannot promise uninterrupted access or that every feature will remain available indefinitely.

Changes remain subject to applicable consumer rights and any commitments made for a paid service. Where required, we will notify you of material changes and provide the remedies required by law.

9. Stopping use and account deletion

You can stop using Tobien at any time. To request deletion of your account, contact vd@tobien.app using the address associated with your account where possible. We may ask for information needed to verify your request.

Uninstalling the app or signing out does not delete your server account. Deletion and any necessary retention are explained in the Privacy Policy. Obligations that need to continue after access ends, including content ownership and applicable liability provisions, continue to apply.

10. Responsibility and consumer rights

We are responsible for providing the service with the care required by applicable law. To the extent permitted by law, we do not guarantee that it will be free from all errors or suitable for every particular purpose, and we are not responsible for losses that were not reasonably foreseeable when these terms were agreed.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud or wilful misconduct, or removes mandatory consumer guarantees, remedies or data protection rights.

11. Applicable law and resolving concerns

These terms are governed by Spanish law, without depriving consumers of mandatory protections available under the law of their country of habitual residence. You retain access to the courts and complaint procedures that applicable law makes available to you.

If you have a concern about Tobien, write to vd@tobien.app so we can try to resolve it. These terms do not require you to waive statutory rights, accept private arbitration or give up a complaint to a competent authority.

12. Updates to these terms

We may revise these terms when features, legal requirements or how the service operates change. The updated date appears at the top of this page. For material changes, we will provide notice and request agreement where required by law.

If you do not accept revised terms, you can stop using the service and contact us about your account. Changes do not remove rights or remedies that have already arisen under applicable law.
